Registration of your property as a holiday rental in Murcia.

When you are renting out your property in Murcia for short periods, you are subject to legal and fiscal obligations.

What’s considered a holiday rental?

Apartment units, bungalows, villas, chalets offered for holiday rental or tourism purposes having met the requirements specified in Decree 75/2005, such as being furnished and equipped and ready to be used immediately for temporary occupancy, commercialised and promoted to tourists via different channels (be it online or offline) and offered with a lucrative purpose.

Holiday accommodation might have different features requirements, but must fulfil two compulsory requirements in order to obtain the licence:

  • First Occupation Licence

  • Comply with the Accessibility requirements

Who needs a licence and what requirements does a holiday accommodation meet?

All owners who aim to rent their property out as a holiday accommodation will have to register it as a short term rental property.

The owner must comply with minimum standards of the dwelling: Hygiene and safety, cold and hot water, electricity, TV, pay all relevant fees and make the property available for inspection. The management company or the homeowner must also maintain the property in optimal conditions, inform guests about the services offered, house rules and emergency contact numbers, provide the manager’s or homeowner’s personal contact phone details and have a home insurance that covers tenants.

How to request a tourist rental licence and procedures to comply with:

A home owner of a property in Spain wanting to rent it out as a holiday / short term home, must go through the following process :

· Registration at the relevant touristic office of the region (where the property is located) by completing the so called Declaration responsible and therefore informing about your intention torent out the property for tourist purposes.

  • Dispose of a civil liability insurance to cover damages to both your home and your tenants. If you already have a home insurance, you will need to extend it to cover your future tenants.

  • Cooperate with the authority and make sure the property is in accordance with the legal provisions, displaying safety signs at the property, allowing the inspectors an initial review and measurement of the property, etc.

  • Make sure that the standards and criteria of the licence will be retained. Also that a minimum of emergency contact numbers (firemen, ambulance, police) are held visible at all times in the property.

  • Allow routine or special inspections, and inform about refurbishments or changes of the property.

The final decision shall be notified within approximately three months although the authorities tend to exceed this period. However, you can start your rental activity from the moment you submit the “responsible declaration”.

Once a property has been authorised a registration number will be assigned to the property.

Tax obligations

Please bear in mind that you are obliged to declare your income to the tax office. Property portals, rental platforms and real estate businesses are now obliged by law to inform the Spanish tax authorities of all the bookings and landlord details.
